A. The Water Fill Station Is an Auxiliary Water Supply – Unapproved.

1. The city of Cle Elum operates a nonpotable water fill station located at Memorial Park Ball Field Parking Lot/South Cle Elum Way.

2. Only licensed contractors with an approved city application are permitted to utilize the water fill station for nonpotable purposes; including, but not limited to, construction activities, landscaping projects, or other approved uses.

3. Fees shall be paid for use of the water fill station in accordance with CEMC Section 13.12.100(H).

4. Any contractor found to be in violation of this provision may be subject to penalties as outlined in subsection (D) of this section.

B. Compliance Requirements.

1. Contractors utilizing the water fill station must comply with all applicable regulations, including but not limited to environmental regulations, water conservation measures, and any restrictions imposed by the city of Cle Elum.

2. All water procured from the water fill station must be used within the critical water supply service area including Cle Elum, South Cle Elum, Roslyn, Ronald, and Suncadia, including the urban growth areas.

3. Failure to comply with these regulations may result in the revocation of access to the water fill station and/or other penalties as deemed appropriate by the city.

C. Monitoring and Enforcement.

1. The city reserves the right to monitor usage at the water fill station to ensure compliance with applicable regulations and may reduce or restrict usage if necessary to maintain an adequate water supply or for any other reason deemed necessary by the city. The city does not guarantee the availability of water at the fill station.

2. Any suspected misuse or abuse of the water fill station may be reported to the appropriate authorities for investigation and enforcement action.

D. Penalties.

1. Violation of the provisions outlined in this section may result in penalties, including but not limited to fines, suspension of access to the water fill station, and other enforcement actions as deemed necessary by the city.

2. Penalties for violations of this section shall be determined in accordance with the penalties outlined in CEMC Section 13.12.210.
